     Abetment to suicide case: rejects bail in   abetment to suicide case

     

    Jammu, March-30-  Special Municipal Mobile Magistrate Jammu M R Chak today rejected the bail application of S. Gurbachan Singh and his son Narinder Pal Singh husband of  Kushbir Kour in abetment to suicide case.

                According to the police case that on 13-03-2017, police of police post Sainik Colony Jammu came to be informed by GMC Jammu that one woman Kushbir Kour W/o Narinder Pal Singh R/o Extension Sector No. 1 Sainik Colony, Jammu is found to have died under suspicious circumstances and her dead body has been shifted by her husband form the Hospital. Upon this information, inquest proceeding were initiated and during the course of proceedings, dead body of deceased came to be taken in custody by the police  and same was sent for post mortem in GMC Jammu. Statements of the witnesses under Section 175 Cr. P.C came to be recorded and on the basis of these proceedings, FIR No. 33/2017 under section 306 RPC came to be lodged and both the accused have been arrested 14-03-2017 and are presently lodged in jail.

                Court after hearing Adv Rajesh Kumar appearing for the applicant whereas Senior PO Anil Dev Singh Jamwal appearing for the state observed that arguments, perused the application, report filled by the police, case diary and also considered the objections filed bythe prosecution. As of now, statement of only one witness i.e mother of the deceased has been recorded, who in her statement under Section 164-A Cr. P.C before the court has deposed that they had given sufficient dowry to their daughter at the time of her marriage in the year 2013 and conduct of her in – laws was cordial with her for about 10 months but thereafter they started harassing her. She has further stated that accused have murdered their daughter and ahe was well educated and would never suicide as it attributed to her by the accused. According to her, accused wanted to dispose of the dead body without conduction autopsy and that way, they wanted to fudge with the evidence to go scot free. Post mortem report has not been received by the I.O and statements of all the other material witnesses are yet to be recorded. Police has seized and made part of the CD file conversation through Whatsapp of the deceased and trying to unveil the circumstances which led to the sudden death of a young lady in the prime of her life. Investigation of the case is still in its infancy and besides recording statements of the witness, post mortem report is yet awaited. Offence under Section 306 RPC is a  heinous offence, in which a young lady has lost her life and circumstances do not warrant indulgence of this Court at this stage whereby accused deserve concession of bail. As far as the ground of illness of accused No. 1 is concerned, there is no medical record suggestive of the fact that his condition will deteriorate in case he remains in detention. With these observations court rejected the bail application.
