Jammu, March-07: CJM Reasi Kamlesh Pandita today rejected the bail application two real brothers namely Mohd. Raiz and Farjaneet Ali S/o Mohd Yousaf Both R/o Budhan Kote Tehsil Throo District Reasi.
According to police case that the accused persons are involved in case FIR No. 15/2017 for commission of offences under sections 366/376/109 RPC. Police report further reveals that complainant/prosecutrix stated before the police that on 13-02-2017 she had gone to attend to the call of nature and after easing out, she was returning to her home when accused persons along with co-accused person Mohd. Farooq abducted her and took her to an isolated place where she was rapped by Mohd. Farooq and she after hard labourer fled from the custody of the Mohd. Farooq and revealed the whole incident to her parents. The police report further reveals that one more co-accused Sh. Khem Raj was also part of the conspiracy for abduction of the prosecutrix. On this complaint, FIR No. 15/2017 for commission of offences under sections 366/376/109 RPC came to be registered against the accused persons and the investigation was set into motion. During investigation statements of the witnesses and the statement of the prosecutrix was got recorded under section 164-A Cr.P.C .
CJM Reasi after hearing both the sides observed that Needless to say that these offences are against the body of a women which is her own temple. These offences which suffocate the breath of life and sully the reputation as the reputation of a women is her richest jewel which one could conceive in life. When a women frame is defiled “the purest treasure “ is lost. No member of a society can afford to conceive the idea that can create hollow in the honour of a woman. Such offences which the accused persons have alleged are not only lamentable but also deplorable. While dealing with the bail applications, no roving enquiry is required but prima facie evidence and gravity of the offences are to be taken into account. With these observations court rejected the bail application. JNF
